1. Introduction
DMVPrepNow.com is operated by Lernova Ventures LLC, a New Jersey limited liability company (“DMVPrepNow”, “we”, “us”). DMVPrepNow is a private, independent educational platform that provides practice tests and study materials for U.S. driver’s license, motorcycle, and commercial driver’s license (CDL) knowledge exams. We are not owned by, operated by, or affiliated with any government agency, including any state Department of Motor Vehicles (DMV), Motor Vehicle Commission, Department of Public Safety, or any other state or federal authority.
These Terms of Use (the “Terms”) are a binding agreement between you and DMVPrepNow. By accessing or using DMVPrepNow.com (the “Service”), you accept these Terms. If you do not agree with them, please do not use the Service.
2. Educational Purpose – Your State’s Materials Govern
Our practice questions are written from each state’s current official driver handbook and are designed to mirror the style and difficulty of real exams. However, official exam questions are drawn from private pools that no third party can predict or reproduce. We do not sell, and no one can sell, the actual questions that will appear on your exam.
Your state’s official driver handbook and the instructions of your state’s licensing agency always take precedence over our materials. Practicing with DMVPrepNow improves your preparation but does not by itself guarantee any outcome on an official exam, except as expressly provided in the Pass Guarantee below.
3. Accounts
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for keeping your password confidential and for all activity under your account.
- An account is personal. Unless it is part of a 1-Year Family plan (see Section 5), it may be used by one person only. Sharing, selling, or transferring accounts is prohibited.
- You must be at least 13 years old to create an account. If you are under 18, you may use the Service only with the consent of a parent or legal guardian, and any purchase must be made or authorized by them.
- We may send Service-related notices to the email address on your account; you consent to receive them electronically.
4. Free Content and Passes (One-Time Payments, No Subscriptions)
Parts of the Service are free for everyone, including free practice tests in every state. Full access is sold as passes:
- Passes are one-time payments for a fixed period (for example, a 7-Day, 30-Day, 90-Day, or 1-Year pass). A pass simply expires at the end of its period.
- There are no subscriptions, no automatic renewals, and no recurring charges. There is nothing you need to cancel. We do not keep your card on file for renewals.
- A pass is bound to one state and one license type (for example, New Jersey + Car/DMV), chosen when the pass is purchased or activated. The bound state and license type cannot be changed afterwards, except at our discretion through customer support. Free content in every state remains available to you regardless of your pass.
- Prices are shown at the time of purchase and may change for future purchases at any time. Price changes never affect a pass you already hold.
5. 1-Year Family Plan
The 1-Year Family plan covers up to five (5) individual accounts belonging to members of one household, each with its own progress, for twelve (12) months. Each covered account is subject to these Terms. The Pass Guarantee (Section 7) applies individually to each covered person who meets its conditions.
6. Early Access Program
During our early access period, some passes may be offered at no charge (“Early Access Passes”). Early Access Passes work exactly like paid passes: they last for a fixed period, they are bound to one state and one license type, and that binding cannot be changed. We may modify or end the early access program at any time; any Early Access Pass already activated remains valid until its expiry date. Where a remedy under these Terms is a refund, the remedy for a $0 Early Access Pass is a free extension instead.
7. Pass Guarantee and Refunds
Pass Guarantee
If you meet all of the following conditions and still do not pass your official knowledge exam, we will, at your choice, either extend your access free of charge or refund the amount you paid for your pass in full:
- you completed every practice test available for your pass’s state and license type;
- you cleared your Fix It Bank (re-answered your missed questions correctly);
- you took the official knowledge exam for that state and license type within thirty (30) days of completing the program; and
- you contact us at support@dmvprepnow.com within fourteen (14) days of the failed exam and provide your official score report or other reasonable proof of the attempt.
Other refunds
Apart from the Pass Guarantee, purchases are final. We will still issue a refund where the Service suffered a verified technical failure on our side that materially prevented you from using your pass and that we could not fix within a reasonable time, or where a refund is required by applicable law.
Billing disputes
If you believe a charge is wrong, please contact us first at support@dmvprepnow.com. We aim to respond within two (2) business days and resolve billing issues quickly. Initiating a chargeback without first giving us a chance to resolve the issue may result in suspension of your account while the dispute is investigated.
8. Limited License to Use the Service
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial exam preparation. You agree not to:
- copy, scrape, harvest, mass-download, or systematically collect questions, answers, explanations, or any other content, whether manually or with automated tools;
- republish, resell, distribute, or make the content available to third parties;
- share account credentials or circumvent access controls, state/license-type bindings, or pass expiry;
- reverse engineer, decompile, or interfere with the operation or security of the Service;
- use the Service to build or train a competing product or dataset.
We may suspend or terminate accounts that violate this section, without refund for the affected pass.
9. Our Content and Trademarks
All content on the Service, including questions, answers, explanations, study guides, text, design, graphics, and software, is owned by DMVPrepNow or its licensors and is protected by copyright and other intellectual property laws. Road sign images reproduced from the federal Manual on Uniform Traffic Control Devices (MUTCD) and sample license images published by state agencies remain the property of their respective sources and are used for educational identification purposes.
“DMVPrepNow” and “Fix It Bank” and associated logos are trademarks of DMVPrepNow. You may not use them without our prior written permission.
10. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to support@dmvprepnow.com including: (a) identification of the copyrighted work; (b) the URL of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature. We will respond to valid notices promptly.
11. Reviews and Feedback
We may invite you to leave a review of the Service on third-party platforms. Doing so is always voluntary, is never a condition of any feature, discount, or the Pass Guarantee, and is governed by the terms of the relevant platform. Any feedback you send us directly may be used to improve the Service without obligation to you.
12. Third-Party Links
The Service links to third-party websites, including official state agency sites and handbook downloads. We are not responsible for the content, availability, or practices of third-party sites, and a link does not imply endorsement or affiliation.
13. Languages
The Service is offered in English and Spanish. Translations are provided for convenience; if there is any conflict between the English and Spanish versions of these Terms or of Service content, the English version controls.
14. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content is current at all times; licensing rules change and your state’s official materials govern. Except for the Pass Guarantee remedy described in Section 7, we make no promise regarding the outcome of any official exam.
15. Limitation of Liability
To the maximum extent permitted by law, DMVPrepNow will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for all claims arising out of or relating to the Service is limited to the amounts you actually paid us in the twelve (12) months preceding the event giving rise to the claim (or, if you have paid nothing, to fifty U.S. dollars ($50)). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to indemnify and hold DMVPrepNow and its officers, employees, and agents harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service.
17. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, power or network failures, hosting provider outages, cyberattacks, labor disputes, or acts of government.
18. Dispute Resolution and Class Action Waiver
Before starting any formal proceeding, you agree to first contact us at support@dmvprepnow.com and give us thirty (30) days to resolve the issue informally; most issues are resolved this way. To the maximum extent permitted by law, disputes must be brought individually: you waive any right to participate in a class action or representative proceeding against us, and we waive the same against you.
19. Changes to the Service and to These Terms
We may modify the Service and these Terms. If we make material changes to the Terms, we will update the “Last updated” date above and, for significant changes affecting paid passes, notify account holders by email or a notice on the Service. Changes do not reduce the rights attached to a pass you already hold. Continued use of the Service after changes take effect constitutes acceptance.
20. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms as described in Section 8. Sections that by their nature should survive termination (including Sections 9, 14, 15, 16, and 18) survive.
21. General
- Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and DMVPrepNow regarding the Service.
- Severability. If any provision is found unenforceable, the remainder stays in effect.
- No waiver. Our not enforcing a provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
- No third-party beneficiaries. These Terms create no rights for anyone other than you and DMVPrepNow.
- Governing law. These Terms are governed by the laws of the State of New Jersey and applicable federal law of the United States, without regard to conflict-of-law rules. Subject to Section 18, disputes will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
